The Bauer Community Center of the City of Port Lavaca: Hereinafter called the Community Center, means any hall, meeting room or other facility including grounds (includes all paved and unpaved areas) located at 2300 N Hwy. 35, Port Lavaca, TX 77979 under the jurisdiction of City of Port Lavaca. B. Lease: As used herein means the written Rental Agreement issued to an applicant by the Community Center Management or its authorized representative for use of the Community Center or any portion thereof under the authority and condition as herein provided, including any amendment or supplement to such an agreement. C. Lessee: As used herein includes any person, association, public organization, partnership, company or corporation that is granted a contract to use any part of the Community Center in accordance with these regulations. Person must be an adult (age 21). Minors must have a parent or guardian sign lease documents.                     D. Lessee Categories for determination of rental rates are: Profit:             When the lease is sponsored by, sanctioned by, for the benefit of, organized by or to be paid for by a profit (oriented or motivated) corporation, company, business, or individual. Non-Profit: When the lease is sponsored by, sanctioned by, for the benefit of, organized by, or to be paid by a non-profit organization, political subdivision, agency or office of the State or Federal governments. Organizations, individuals or businesses do not receive free use of the Community Center. The only provision for fee waived use is a City Authorized function or by authorization by the Community Center Management. Non-profit/non-commercial events: A non-profit or non-commercial event is a function sponsored by any of the following categories when a minimum of 5% of gross proceeds are bestowed on or retained by the sponsoring organizations. Organizations claiming non-profit status must present a certificate of registration issued by the Secretary of State of Texas upon request. EXAMPLES:                     1. Non-profit chartered civic organizations.                     2. Non-profit fraternal organizations.                     3. Governmental organizations.                     4. Non-profit educational organizations.                     5. Non-profit religious organizations.                     6. Chartered charitable organizations 7. Organizations exempt from federal income as provided in    Section 501 (c) of the Internal Revenue C                     8.  Religious or charitable organizations exempt from ad valorum taxes as                         provided in Chapter 11 of the Property Tax Code of the State of Texas.                      9. Organizations exempt from the corporate franchise tax of the State of Texas. E. Closed events - leases made by an individual for purposes such as private dances or family celebrations, not open to the general public, will automatically qualify for the non-profit category. SECTION 2: RIGHT TO ALTER REGULATIONS AND RENTAL RATES The City of Port Lavaca reserves the right to change, alter, amend or cancel any or all of the regulations and rental rates contained herein at any time. The City Council reserves the right to cancel any reservation for the use of the Community Center due to local, state or federal emergency needs. A full refund will be given in this event. The user may not use the facility for any other than the stated purpose. Failure to comply can cause cancellation of the event. SECTION 3: AUTHORITY These regulations and rental rates are adopted by action of the City Council of the City of Port Lavaca. Violations of these regulations and rental rates or any portion thereof will be considered as violation of the Ordinance. Violations will be subject to penalties as detailed in the Ordinance or other appropriate City Code. The Community Center Management, hereinafter referred to as management shall have full responsibility for the operation of the Community Center and shall act on behalf of the City of Port Lavaca. The management shall be authorized to enter into agreements subject to the rental schedule contained in these regulations and subject to Sec. 2 (above). The right is reserved by the manager or other duly authorized representatives of the City of Port Lavaca to enter the Community Center and all parts thereof at all times. SECTION 4: RENTALS AND RENTAL AGREEMENT All rentals of Community Center facilities or grounds will require a signed rental agreement between the lessee and the City through its duly authorized representatives. No oral agreements for the use of the Community Center will be valid. SECTION 5: RESERVATION INFORMATION A. Reservations will be taken at the offices of the Bauer Community Center Monday through Friday, except for official holidays, between the hours of 8:00 A.M. until 12:00 Noon and 1:00 P.M. until 5:00 P.M. Correspondence or requests for information need to be mailed to the following address: Bauer Community Center P.O. Box 105 Port Lavaca, Texas 77979 Telephone reservations and information may be obtained by: Phone 361-552-1234 B. The Community Center will be rented on a first-come first served basis. Reservation request conflicts will be resolved by the management or his authorized Representative. C. Reservation Confirmation: A reservation for the Community Center will be considered confirmed only upon the receipt in the Community Center Office of a signed Lease Agreement accompanied by the prescribed minimum down payment or other appropriate fee as described herein. Telephone reservations will be accommodated by the City. All such verbal reservations must also be confirmed in accordance with the reservation confirmation procedures no later than ten calendar days following the issuance of the Rental Agreement. If the signed rental agreement is not returned within ten calendar days following the issuance of the rental agreement, the reservation is automatically void. D. Reservation Time Limits and Conditions: 18 MONTHS PRIOR TO EVENT: Earliest possible time for reserving the Community Center for a qualified multi-day event. Reservation of the facilities for events in which the event itself (not including set-up, tear-down or clean-up time) lasts at least three (3) days, and which was held and lasted three (3) days in the previous year, may be made up to twenty five (25) months in advance of a date. Twenty five (25) months shall be interpreted to mean all of the 25th calendar month prior to the day in which a leased event is to occur. (Example: On any July 1, the facility may be reserved by a qualified 3-day event for any date through the month of August, twenty five (25) months hence.) A minimum of 10% of the total rental fee (rental fee plus deposit) is required as a Downpayment ten (10) days following issuance of the rental contract. 12 MONTHS PRIOR TO EVENT: Earliest possible time for reserving the Community Center for other than multi-day events. Reservation of the Community Center may be made up to twenty four (24) months in advance of a date. Twenty four months shall be interpreted to mean all of the 24th calendar month prior to the day on which a leased event is to occur. Example: On any August 1, the facilities may be reserved for any date through the month of August, twenty four months hence. A minimum of 10% of the total rental fee (rental fee plus deposit) is required as a Downpayment ten (10) days following issuance of the rental contract. 45 DAYS PRIOR TO EVENT: Reservations made after this time must pay 100% of rental fee plus any required deposit 10 days following issuance of the Rental Agreement. All fees on existing Rental Agreements must be paid in full at this time. ONE WEEK PRIOR TO EVENT: No reservations may be made later than one week prior to requested date. E. Reservation of the entire Community Center facilities (including grounds) for functions or events above will be eligible to charge admission fees (set by the lessee) for access to the parking areas with prior approval of the Director of Parks and Recreation. F. CANCELLATION TERMS AND CONDITIONS FOR THE COMMUNITY CENTER: 3 MONTHS PRIOR TO EVENT: Latest possible time to cancel event without penalty. All monies paid by lessee will be refunded. LESS THAN 3 MONTHS BUT GREATER THAN 30 DAYS PRIOR TO EVENT: Voluntary cancellation by lessee during this time will result in forfeiture of down payment. 30 DAYS PRIOR TO EVENT: Voluntary cancellation by lessee during the last 30 days results in 100% forfeiture of total fee including any required deposit to City. SECTION 6: RENTAL HOURS          A. The Community Center will be available for rental events     between    the              hours     from 8:00 A.M. and 12:00 A.M. the following morning (16 hours) which shall constitute a rental day.                                         B. The Community Center facilities will be leased on a daily basis. C. All late-night usage of facilities must end no later than 1:00 A.M. Lessee,bands, caterers and all occupants must vacate the facilities no later than 1:30 A.M. Failure to leave the premises within the 30 minute grace period (1:00 A.M. to 1:30 A.M.) will result in a late hours extension charge being assessed and will be grounds for refusal of future facilities leases to the lessee. Some late night events may require police security to remain on duty until facilities are completely vacated and the building can be closed. DEPOSITS REQUIRED PER FACILITY: To cover damages, early entry, late hours extensions, accessory items and any other usage fees: Main Room $250.00 Side Rooms $75.00 each All required deposits will be included in the rental contract total. Refunds of deposits will be made, minus reasonable deductions for excessive clean-up, late hours extension, accessory items or damages, within 30 days after rental. Additional fees will be charged for Excessive Cleaning required (to be determined by Community Center Supervisor) such as, but not limited to, damaged or stained flooring or walls, etc) or for damage and/or repair costs in excess of the Deposit paid. CLEANING REQUIREMENTS: Lessee must clean up any and all trash, litter or decorations and remove any equipment within the contract lease period; otherwise, additional fees may be charged or deducted from deposits for the additional time used. Lessee is responsible for cleanup of the facility similar to pre-event condition. Lessee is responsible for cleaning the Kitchen after usage (clean counter tops, mop floor and dispose of all trash from area into available receptacles). Failure to do so will result in forfeiture of deposit. Cleaning Fees: Main Room $250.00 Kitchen $ 75.00 B. ACCESSORY ITEM FEES: Portable Staging (10 sections) $12.00 per 4x8 Section Marquee Advertising $25.00 per event/charge NOTE: The Portable Stage and Marquee advertising must be scheduled prior to event for availability on day of setup. The following accessory items are available with the rental of Community Center facilities at no extra charge: Microphones Projector Screen Overhead Projector TV/VCR C. Setup or Teardown Time: Will be one-half (1/2) of the regular rate. D. Recreational Vehicles Parking Fee: Recreational vehicles may not stay on the Bauer Community Center grounds. Lighthouse Beach RV Park is located directly across the street from the Bauer Community Center with their own fees for overnight stay. E. Storage Fee: $50.00 per day will be assessed to the lessee for materials and/or equipment remaining on the premises after a lease terminates. F. Late Hours Extension Fee: For use beyond the contracted 30 minute grace period, assessed at the rate of $25.00 per one-quarter hour (15 minutes) or any portion of one-quarter hour. This charge will be deducted from Lessee's deposit and/or invoiced following the event.  G. EARLY ACCESS: Is permitted to Community Center grounds or facilities prior to a rental time block or blocks under the following criteria: 1. The Manager must verify that the facility will be ready for occupancy at the time requested by the Lessee. Such access will not conflict with any other event or Lessee. For Early Access fees see Rate Chart, Page 9. H. PAYMENTS: A minimum of 10% of the total rental fee (rental fee plus deposit) is required as a downpayment ten (10) days following issuance of the rental contract. A late payment fee of $25 will be assessed on existing contracts if balance is not paid by stated due date on the contract. Payments within the 45-day limit will be accepted in the form of Bank Draft, Money Order or Cash only. Personal checks are acceptable only from the Lessee- third party checks are not an acceptable means of payment. RETURNED CHECKS/INSUFFICENT FUNDS: Any check returned for any reason non-paid from the bank will result in a $25.00 handling fee. Checks must be picked up and paid for by Bank Draft, Money Order or Cash. Such occurrences will result in future rental payments being accepted only by Bank Draft, Money Order or Cash. LATE PAY FEE: (Past Due Accounts) - Lessee will be charged a late fee of $25.00 for failure to pay fees on time. This fee will be assessed to Lessee for failure to pay the balance owed 45 days before the first day of the reservation or for failure to pay for rental of service(s) provided during the event, such as, marquee advertising, Portable Staging within ten days after issuance of the invoice. SECTION 8: PARKING AND DELIVERIES: The Front Portico Entrance is for the arrival and departure of customers and their guests during scheduled events. Parking of vehicles is not allowed on any part or portion of the Portico Walkway or in any landscaped area. Customers are responsible for informing guests, caterers, suppliers, decorators, etc. of these restrictions. Delivery of supplies and decorations, catered meals, bands and all other supplies and materials are accepted ONLY at entrances as detailed below. Do not leave vehicles parked at delivery entrances for extended periods. Deliver items and relocate vehicle to the parking lot. SECTION 9: POLICE SECURITY The Lessee is responsible for providing and paying for police security. Failure to arrange for Police Security within two weeks prior to the event will constitute grounds for cancellation of an event. Lessee shall be provided a SAMPLE Police Security Confirmation Form. An Original Form will be supplied to the Police Department for verification of Police Security and Fire Marshall Service. It is a condition of rental that Lessee contact the Port Lavaca Police Department at least 10 days in advance at 361-552-3789 for a determination of security requirements and completion of the Police Security Form. Estimated attendance shall be the same as on the Setup Diagram. Officers will remain on duty during the event and/or when alcohol is being consumed and until the building is vacated and the doors can be closed. If the reservation is cancelled, Lessee is responsible for contacting the Police Department for cancellation of Police Security. SECTION 10: FIRE SECURITY: The City of Port Lavaca Fire Code will be enforced at all events. The user shall not store any motor fuel in the Community Center. Fuels tanks, boats, vehicles or other equipment on display will be secured in accordance with the instructions of the Fire Marshall. Regular exit doors, walkways and fire extinguishers shall not be blocked. Marked fire lanes will be kept open at all times. Cooking is not allowed in the Community Center. A catering kitchen is available. It is the users responsibility to conform to capacity ratings. G. BUILDING CAPACITIES: Building Capacities of all facilities are posted in the buildings and will be enforced by the Fire Marshall at all events. It is the Lessee's responsibility to conform to these capacity ratings. BUILDING OCCUPANT CAPACITIES: Main Hall- 740 Side Rooms- 80 for each room SECTION 11: SETUPS AND DECORATIONS A. The Lessee is required to submit diagrams of seating arrangements for their event to the Community Center Office at least two weeks prior to the date of the event. A blank Facility Diagram is included in the Contract Packet. Estimated attendance shall be the same as stated on the Police Security Form. Assistance for planning seating arrangements is available through the Community Center Office. All seating changes will be the responsibility of the Lessee. If the Lessee does not submit a diagram, an arrangement appropriate to the event will be chosen by the Parks Director or his designated representative and will be set up prior to arrival of the Lessee. B. Community Center tables and chairs may be used in the Community Center building. Tables and chair are not permitted outside of the building. C. Tables and chairs are for exclusive use of the Lessee and will not be sublet by the Lessee. D. Decorating is the responsibility of the Lessee. Decorations may be of any type or design as long as installation and placement does not interfere with emergency ingress or egress, violate the fire code or cause damage to the Community Center. Decorations may be freestanding only; tape, pins, tacks, staples etc. are not allowed. Decorations may not be hung from ceilings. The Community Center does not provide devices for attachment of decorations. Armour-All or like products used on tires or other vehicles parts must be applied before the vehicle is brought inside the building. E. The Lessee may be required to furnish in writing any information requested by the management to determine which facilities, arrangements, special services and/or equipment might be necessary to the staging and proper management of any event. Lessee must furnish drawings for exhibitions or conventions as to location and dimensions of exhibit booths and equipment indicating utility requirements. These requirements must be approved by the manager.   SECTION 12: PERMITS AND LICENSES The sale of alcoholic beverages will be permitted only by non-profit organizations as part of their fund-raising events. The renter must accept all responsibility for, and hold harmless, indemnify and defend the City from any liability or expense arising out of the sale and/or use of alcoholic beverages at the Community Center facility or grounds. It is the responsibility of the renter to obtain the appropriate permit or license when applicable prior to leasing any of the facilities of the Community Center. SECTION 13: INSURANCE (when needed) The Lessee shall be required to obtain policies of insurance issued by companies authorized to do business in the State of Texas. The Insurance policies shall contain an endorsement providing Contractual Liability coverage to insure the liability assumed herein. Lessee must also provide Certificates of Insurance (Liability), naming the City of Port Lavaca as an additional insured in the following amounts: A. Comprehensive General Liability - (Including spectator liability) providing the following limits: A combined single limit policy form (Bodily Injury and Property Damage limits combined) of $300,000.00 per occurrence, or… Bodily Injury Liability - $300,000.00 per occurrence Property Damage Liability - $100,000.00 per occurrence. B. Workers Compensation Coverage as required by Texas Statute. The manager shall be provided with a Certificate evidencing all such insurance as specified herein, and any other insurance which the Parks Director may require. The manager may waive or reduce the insurance requirement in certain instances where the general public will not be in attendance at a particular program or where a particular program or event involves limited exposure to liability. SECTION 14: LIABILITY FOR LESSEE'S PROPERTY Neither the City of Port Lavaca, nor its employees shall be liable for any loss, damage or injury to property of any kind that is shipped or otherwise delivered to or stored in or on the premises. Property shall not be received until Lessee has made proper arrangements for receiving, handling, and storage of such materials with the Community Center manager. SECTION 15: ADVERTISING OF EVENTS A. All advertising of paid attractions must state total admission prices. The Lessee shall not announce events scheduled at the Community Center until contracts have been properly approved and executed by the Manager. Fees for advertising on the marquee signs in front of the Community Center are located on Page 11, Section 7. B. Commercial advertising, whether promotion of a product, service, or endorsement of Lessee’s event is permitted. C. The Community Center reserves the right to display notices of future events. Lessee must provide the manager with promotional material at least one week prior to the date of any event for it to be included in any display. Signs may only be posted on Bulletin Boards provided for such use within the Community Center. All such advertisements must relate to the event to be held on the premises. At no time shall any such advertising matter be distributed or circulated on parking facilities or walkways adjacent to the facility. SECTION 16: OBSERVANCE OF LAWS AND REGULATIONS The Lessee shall comply with all city, county, state and federal laws, and with regulations pertaining to the Bauer Community Center. Violations by the Lessee or its agents or employees may result in cancellation of the Lease and/or discontinuation of use of the facility. SECTION 17: OBJECTIONABLE CONDUCT Any person at the Community Center whose conduct is disorderly or disruptive in one or more of the following respects, may be ejected from the premises by the Manager or the Manager's designated representative or any police officer: Intoxication; Use of abusive, indecent, profane or vulgar language; Making offensive gestures or displays; Abusing or threatening another person in an obviously offensive manner or fighting with another person; Making unreasonably loud noise; Vandalism. The Lessee for the event at which any such ejection occurs shall hold harmless, indemnify and defend the City, its officers, agents and employees against any claim related to any such ejection. SECTION 18: OBSTRUCTION OF ACCESS No portions of the sidewalks, entries, walkways, passageways, doors, aisles, vestibules or other ways of access to the public utilities of the premises shall be permitted to be obstructed, nor shall any windows, ventilators or lighting fixtures be obstructed. SECTION 19: ABANDONED EQUIPMENT OR ARTICLES The City shall not be held responsible for property left on the premises. Said articles shall remain on the Community Center premises for 30 days and then shall be deemed abandoned by the Lessee and may be disposed of by the Manager. The City assumes no responsibility for losses of property when such losses are caused by theft or disappearance. SECTION 20: SOLICITATIONS No Lessee shall solicit or collect donations at the Community Center without the approval of the manager. SECTION 21: COPYRIGHT INFRINGEMENT The Lessee must accept all responsibility for, and hold harmless, indemnify and defend the City of Port Lavaca, from any liability or expense arising out of the use of any compositions of members of the American Society of Composers, Authors and Publishers, or any other copyright owner, that shall be performed in connection with any use of the Community Center whether amplified, televised or otherwise not in the form of a mechanical recording or personal rendition, unless the sponsor of the program has first paid any fee required; and the Lessee shall provide satisfactory evidence of such payment to the manager prior to such program. SECTION 22: CONVENTIONS A. The management may negotiate to lease any of the Community Center facilities to any corporation, association, club or society during an International, National, State, or Regional seminar or meeting session thereof, which is a Convention of Record as recorded by or in the files of the International Association of Convention Bureaus, or with the Texas State Association of Convention Bureaus. B. The management reserves the right to waive reservations regulations contained in Section 5 in order to negotiate a lease to a Convention of Record as defined in Part (A) above. C. The management shall have the ability to negotiate with conventions to come to Port Lavaca. The purpose of negotiations is to invite Conventions of Record to Port Lavaca and to stay in Port Lavaca Hotels/Motels. The Management shall have the ability to waive all cost for out of town conventions if they stay in Port Lavaca Hotels/Motels at least 2 nights and have at least 200 people in the Convention. SECTION 23: BASIC SERVICE A. The Bauer Community Center's rental includes the following services as required for any event: Electricity (wall outlets) Lights Water Public address system Heat and/or air conditioning Table/chair setups Stage B. Failure to furnish any of the services as noted in Subsection A above resulting from circumstances beyond the control of the Community Center will not be considered a breach of contract by the City. SECTION 24: BASIC REQUIREMENTS AND CLEANUP User of the Community Center agrees to: Clear tables of any debris or food Bag and remove trash to outside containers – Any trash which will create odors must be removed (shrimp, fish, crawfish, etc.) Use of nails, tacks, staples or scotch tape when decorating walls is strictly prohibited. Remove all decorations and personal belongings at end of event. No tape such as duct, electrical or other is allowed on floors Pick up trash in parking lot Clean up spills on tables, chairs and floors All guests are the responsibility of the renter and should remain inside the room of the event, unless using facilities outside of rented area.
